Terms of service

This English version is a courtesy translation. If the two versions differ, the Italian version prevails.

1. Who sells

The products on www.yfactnutrition.com are sold by Y Fact S.r.l., Via Amerigo Vespucci 9/D, 80142 Napoli (NA), VAT no. 11022791211, Naples Register of Companies REA NA-1149344, certified email (PEC) yfactsrl@pec.it - hereinafter "Yfact". Contact: info@yfactnutrition.com. The products are made in Italy.

2. What these terms govern

The distance selling of food supplements to consumers resident in Italy, through this website. By placing an order you declare that you are at least 18 years of age and that you are acting as a consumer. We do not sell to resellers through this channel.

3. How the contract is concluded

The contract is concluded when you receive our order confirmation email. Before then you may change your cart or stop the purchase. We reserve the right not to accept an order if the product is unavailable, the payment details are invalid or there is a manifest error in the price: in that case we inform you and refund in full any amount already charged.

4. Prices

All prices are in euro and include VAT. The price applied is the price displayed at the time of the order. Shipping costs, where due, are shown before confirmation: no cost appears by surprise at checkout. Yfact may change its prices at any time, but the change does not affect orders already confirmed or the renewals of an active subscription without prior notice (point 5).

5. Subscription

If you choose the subscription:

• you receive the product every month, and payment is charged on the date of the first order;
• the price is the one shown at the time of subscribing and remains unchanged for the whole duration of the subscription. Should we change it, we will notify you at least 30 days before the renewal, and you may cancel at no cost;
• you may pause, skip a delivery, change address or cancel at any time from your account, without penalties and without having to contact us. The change takes effect from the next delivery, provided that it is made before the renewal date. To change product, write to us at info@yfactnutrition.com: we make the change for you from the next delivery;
• three days before each renewal we send you an email reminding you of it;
• the subscription has no minimum duration and is not renewed for binding periods: it is monthly and always reversible.

6. Payment

We accept the payment methods shown at checkout. The transaction is handled by the payment provider: Yfact does not store your card details. The order is prepared once receipt of payment has been confirmed.

7. Shipping and delivery

Methods, times and costs are set out on the shipping page, which forms an integral part of these terms. The risk of loss of the goods passes to you upon physical delivery.

8. Right of withdrawal

You have 14 days from delivery to withdraw without having to give any reason (Articles 52 et seq. of the Italian Consumer Code, Legislative Decree 206/2005).

Important exception: pursuant to Article 59(1)(e) of the Italian Consumer Code, the right of withdrawal does not apply to sealed goods which are not suitable for return for reasons of hygiene or health protection, once they have been unsealed after delivery. In practice: a Yfact jar can be returned only if it is intact and with the seal unbroken.

You can also withdraw online, without an account, using the “Withdraw from contract here” button at the bottom of every page of the website: you immediately receive confirmation by email, with date and time (Article 54-bis of the Italian Consumer Code). Commercial "money-back" guarantee: on the first jar of each product you also have 30 days to try it, and we refund you even if you have opened it. Conditions and procedure in point 10 of the returns and refunds page. It is in addition to the right of withdrawal and the legal guarantee, which remain valid.

9. The products

Food supplements are not a substitute for a varied and balanced diet and a healthy lifestyle, and they are not medicinal products: they do not cure, do not prevent and do not treat any disease. Always read the warnings on the label before use, do not exceed the recommended daily dose, keep the product out of the reach of children under 3 years of age. The products are not recommended for children under 12 years of age. In case of pregnancy, breastfeeding, ongoing drug therapy or particular conditions, consult your doctor before taking them.

Product images are for illustrative purposes only: the description and the label of the product received are authoritative.

10. Legal guarantee of conformity

The products are covered by the legal guarantee of conformity (Articles 128 et seq. of the Italian Consumer Code). As these are foods with a date of minimum durability, the guarantee applies until the best-before date printed on the pack. If you receive a product that is defective, damaged or expired, write to us at info@yfactnutrition.com attaching a photo and the order number: we replace it or refund it, at no cost to you.

11. Liability

Yfact is liable within the limits provided by law. We are not liable for delays or failed deliveries due to force majeure or to incorrect delivery details provided by the customer. No clause of these terms limits the rights that the law grants to the consumer on a mandatory basis.

12. Intellectual property

The trademarks, texts, photographs and graphics of the website are owned by Yfact or used under licence. KSM-66 is a trademark registered and owned by Ixoreal Biomed Inc.

13. Complaints and dispute resolution

For any complaint write to info@yfactnutrition.com: we always look for a direct solution, and it is the quickest route. This is without prejudice to the possibility of turning to a mediation or alternative dispute resolution (ADR) body entered in the ministerial registers.

14. Applicable law and jurisdiction

Italian law applies. For disputes with a consumer, exclusive jurisdiction lies with the court of the place of residence or elected domicile of the consumer, if located in Italy (Article 66-bis of the Italian Consumer Code).

15. Changes

We may update these terms: the version applicable to your order is the one published at the time you place it.
